If you were Rizal's defense lawyer, what could have you done to save Rizal's from his death sentence?

Answer:

If I were the defense lawyer of Jose Rizal, I will do something to protect him from the death sentence by studying the entire case. Probably, I will present some important papers, supporting documents to stop authority from pushing him to trial. I will prove to the Spanish authority that their allegation was wrong and it must be corrected before they execute Rizal to death. Spanish authorities during the time of Rizal were very strict, If they heard someone who was against them will be killed. They do not have trials, what they did, was putting someone in prison without a hearing and justice. Spanish times were dark times of all Filipino People.

5. If you were Rizal's lawyer in his trial, how can you defend him using the 12 points that Rizal also announced earlier in his proceedings?

Answer:

Defend Rizal as his defense lawyer? On a trial of rebellion, yes. But that trial must be by a civilian court, either in a primer instancia or direct to a special court handling rebellion cases. It must not be a Court Martial or a Military Commission reporting direct to a military governor general. But as things stand in 1896, poor Jose was a cooked goose. The Court Martial has to have the usual suspects, and our doctor-poet-lover (not to say with two novels) and reluctant rebel got a slim margin between the devil and the deep blue sea.The defense will be along the lines of evidence need to convict a person with rebellion charges. Witnesses of the prosecution will be put on the dock and subjected to withering cross-examination questions and physical evidence will be subjected to minute scrutiny, all in accordance with the existing Rules of Court; not in a court martial which fashion its Rules as the trial moves. The 1896 court martial was designed to convict and execute. Eventually, Spain lost her empire.

6. in your own words described the tension on the court when rizal read his defense

Initial Investigation

On November 20, 1896, the preliminary inquiry against Rizal began after gathering as much information as possible. Rizal was briefed of the allegations against him before Judge Advocate Colonel Francisco Olive during the five-day investigation.

He was subjected to interrogation without knowing who testified against him. There were two types of evidence presented to him: documentary and testimonial.

Colonel Olive forwarded these evidences to Governor Ramon Blanco, who appointed Captain Rafael Dominguez as the Judge Advocate in charge of determining what action should be taken. Dominguez, after a cursory perusal, forwarded the data to Judge Advocate General Don Nicolas de la Pea for his opinion. Pea's suggestions were as follows:

Rizal must be tried quickly to trial. He must be imprisoned with the required security. His holdings had to be attached, and Rizal had to pay one million pesos as an indemnity.Only an army officer is permitted to represent Rizal, rather than a civilian counsel.

I investigated his case and discovered nothing that might implicate him as a participant in, or even the leader of, the revolution. Rizal is innocent as he is, and I ask you to put all biases aside right now because I will establish his innocence at whatever cost.

The first two evidences you presented in this court are documented proofs of letters showing Rizal's connection with Filipino reform in Spain, the implications of Rizal in the Propaganda Movement in Spain, and that and that of which contains his sentiments on deportations to be vital in encouraging people to hate tyranny.

11. if yo had been Rizal lawyer, what could have you done to save Rizal from his death sentence?

Answer:

It wouldn’t be a defense so much as a strategy. I’d offer to plead guilty to sedition if the conspiracy and rebellion charges were dropped, pointing out to the prosecutor that Rizal publicly disavowed the revolution and executing him would only add fuel to the fire. Trying to win at trial is a losing proposition, the outcome being fixed, so the best option for my client is to play for lenience.

25. If you had been Rizal's lawyer, what could have you done to save Rizal from his death sentence?

Answer:

If I had been Rizal's lawyer, I would have argued that the charges against him were politically motivated and that he was being persecuted for his political beliefs. I would have also argued that the evidence presented against him was circumstantial and insufficient to prove his guilt beyond a reasonable doubt. Additionally, I would have argued that Rizal had not committed any crime and that his writings were not seditious or intended to incite rebellion. Finally, I would have argued for clemency on the grounds of Rizal's exemplary character and contributions to Philippine society.

Explanation:

Rizal was a Filipino nationalist and political activist who was charged with sedition and rebellion against the Spanish colonial government. His trial was widely seen as politically motivated, and his lawyer would have argued that the charges were baseless and that Rizal had not committed any crime. The lawyer would have also argued that the evidence presented against Rizal was circumstantial and insufficient to prove his guilt beyond a reasonable doubt. Additionally, they would have argued that Rizal's writings were not seditious or intended to incite rebellion, but rather were intended to promote reform and peaceful change. Finally, they would have argued for clemency on the grounds of Rizal's exemplary character and contributions to Philippine society.
